DISCLAIMER & LIMITATION OF LIABILITY

By booking our services, you (“the Client”) agree to the following terms and conditions:

GENERAL DISCLAIMER

Ever After Entertainment (“we,” “us,” or “our”) provides rental services, including but not limited to Mini Golf, Audio Guestbook, and Lawn Games, for various events. While we strive to offer a seamless and enjoyable experience, we do not guarantee uninterrupted, error-free, or completely secure services.

“AS IS” AND “AS AVAILABLE” DISCLAIMER

Our services, website, and any related materials are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied. Ever After Entertainment makes no guarantees regarding the availability, performance, or accuracy of its services and disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, timely, secure, or error-free. We are not responsible for any issues arising from software glitches, hardware failures, internet connectivity issues, or third-party service disruptions. Clients and guests use our services at their own risk, and Ever After Entertainment assumes no responsibility for dissatisfaction or technical failures.

ASSUMPTION OF RISK

By booking and using our services, the client and their event guests acknowledge and accept that participation is voluntary and undertaken at their own risk. Ever After Entertainment is not responsible for any personal injuries, allergic reactions, or damages arising from the use of equipment, or third-party vendors associated with our services.

LIMITATION OF LIABILITY

To the fullest extent permitted by South African law: Ever After Entertainment, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of our services, including but not limited to loss of data, damage to property, personal injury, or claims by third parties. We shall not be responsible for service delays, failures, or disruptions caused by circumstances beyond our control, including but not limited to equipment malfunction, planned or unplanned power failures, or force majeure events (e.g., extreme weather, strikes, government actions, or natural disasters).

IDLE TIME CLAUSE

Idle time refers to any period when the rental is set up but temporarily not in use at the client’s request. Idle time is billed per hour rate at a reduced rate compared to active time and must be pre-arranged unless otherwise agreed upon. You are required to arrange for idle time in advance to ensure smooth scheduling. Idle time cannot be used to extend the event beyond the agreed rental period unless additional time is purchased. Setup and breakdown times are separate from idle time and are not charged unless an early setup is requested outside the standard timeframe.

DATA PROTECTION & PRIVACY

By using our audio guestbook services, guests consent to being recorded. Ever After Entertainment may use event recordings for marketing and promotional purposes unless the event organizer explicitly requests otherwise in writing at least 15 days before the event. Personal data collected during bookings (e.g., names, contact details) will be stored securely and will not be shared with third parties without consent.

ALCOHOL, CONDUCT & SUPERVISION

Ever After Entertainment reserves the right to refuse service to any guest who is excessively intoxicated, behaves inappropriately, or poses a risk to our staff or equipment. Any inappropriate or offensive behavior captured in the audio guestbook will not be the responsibility of Ever After Entertainment. Parents or guardians must supervise children under 12 years old when using our equipment. We are not responsible for injuries or damages resulting from unsupervised children’s use of our equipment.

OUTDOOR EVENTS & WEATHER CONDITIONS

Ever After Entertainment offers outdoor rental services but is not liable for disruptions due to weather conditions (e.g., rain, wind, extreme heat). The client must provide adequate shelter for our equipment at outdoor events. If weather conditions prevent safe operation, we reserve the right to modify, pause, or terminate the service without refund.

SET UP, TRANSPORT & VENUE REQUIREMENTS

The client is responsible for ensuring the event venue provides sufficient space, power supply, and access for setup. The client will arrange for an appropriately sized space for the chosen rental at the event venue. The Client must provide a completely flat and even surface for the rental to be placed on, with no significant inclines or unevenness, to ensure proper operation and prevent damage to the equipment; essentially, a stable area without any bumps or dips. Additional fees may apply for venues requiring stair access or long-distance transport. Ever After Entertainment is not responsible for venue restrictions that prevent proper setup or operation.

EQUIPMENT & PROPERTY DAMAGE

Clients and guests are responsible for any damage to Ever After Entertainment’s equipment, including but not limited to golf clubs, golf balls, game pieces, props, and accessories, caused by negligence, rough handling, or intentional misuse. The client who booked the service will be liable for repair or replacement costs in such cases.

CHANGES TO THIS DISCLAIMER

Ever After Entertainment reserves the right to update or modify this disclaimer at any time without prior notice. Continued use of our services after such modifications shall constitute acceptance of the updated terms.

GOVERNING LAW & JURISDICTION

This Disclaimer & Limitation of Liability shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the South African courts.
